  • Nov. 12, 2014 FRN: Final guidance re: Corridor preservation for transit projects

    FTA – notice of final guidance for preservation of corridors for future transit projects, in light of MAP-21 amendments to the code to allow certain acquisitions before completion of NEPA.  The guidance addresses the type of ROW to which the MAP-21 provisions apply, and explains the related conditions and requirements.  FTA had included a link to the final guidance application, however an incorrect version was accidently posted prior to 11-19-14, the correct version is here:  http://www.fta.dot.gov/12347_15129.html.

  • Nov. 7, 2014 FRN: Entry Level Driver Training Survey

    FMCSA – the agency is planning to submit an Information Collection Request to gather information regarding the connection of CDL entry level driver training, as effected by subsequent employer training given, to safety performance of the drivers. Results from the study and other sources will provide information to FMCSA backing its knowledge of heightened MAP-21 minimum training requirements for CDL ELDT drivers from those that are currently required.

  • October 24, 2014 FRN: Final circular for Sec. 5311
    No request for comments
    FTA – notice of final circular for Sec. 5311 Rural Area Formula Program, reflecting the MAP-21 changes. The Iowa DOT and several others asked for clarification on the topic of subrecipients for Sec. 5311 funds. FTA revised the circular to clearly indicate that non-profits are eligible subrecipients. Other issues reported in the notice include: FTA’s response to a commenter’s observation about the difficulty of replacing vehicles since Sec. 5309 was repealed, and; use of the terms “senior”, “welfare recipient” and “eligible low-income.” Also discussed is the eligibility of feeder bus service to rail and other networks. This circular is effective Nov. 24, 2014.

  • Oct. 10, 2014 FRN: State of Texas DOT application for NEPA reviews

    FHWA –Federal officials have reached an agreement with the Texas DOT to let them assume responsibility for NEPA reviews on transportation projects with FHWA oversight.   Texas DOT applied for this through the Surface Transportation Projects Delivery Program; previously a pilot program.  Section 1313 of MAP-21 made the program permanent and did away with the 5 state cap.   A proposed memorandum of understanding is open for comments.

  • Sept. 16, 2014 FRN: Surface Transportation Project Delivery Program

    FHWA, FTA & FRA – these agencies have issued a joint final rule making the Surface Transportation Project Delivery Pilot Program a permanent program, as required by MAP-21. The program will allow all states to assume responsibilities for NEPA reviews, along with other changes. New rules will be effective within 30 days.

  • Sept. 5, 2014 FRN: Value Engineering/cost benefit changes

    FHWA – final rule revising Value Engineering requirements for NHS projects, mostly to conform with MAP-21. Changes include: increasing the threshold that triggers a required VE analysis to $50 million for highways and $40 million for bridges; exempting design-build projects; removing the requirement for VE analysis on bridges OFF the NHS; and expanding the policies and procedures of state DOT VE programs to cover, for instance, implementation of the recommendations.     FTA – notice that FTA has issued a final circular incorporating MAP-21 provisions re. the use of FTA funds or FTA-funded real property in connection with joint development (defined in the circular as public transportation projects that involve commercial, residential, mixed-use, or other non-transit development, including intermodal facilities, intercity bus and rail facilities, transit malls, or historic transportation facilities). The notice mentions that the term “joint development” is often used interchangeably with “transit oriented development,” but that FTA considers TOD to have a broader, community-size scope.   • August 4, 2014 FRN: weighting factor for CMAQ set-aside

    FHWA - request for comments on administrative or other costs to states due to FHWA setting a weighting factor to be used in calculating a CMAQ set-aside aimed at addressing particulate matter. MAP-21 requires this set-aside, but provides no weighting factor. When creating the apportionment tables for FY 2013 and 2014, FHWA used a factor of 1.2 for the particulate matter set-aside. This was based on an earlier draft of MAP-21, and the factors used for ozone (1) and CO (1.4). However, given the significantly higher health impact of particulate matter, FHWA is proposing to set that weighting factor at 5.The notice emphasizes that the change will not impact a state's overall CMAQ apportionment – only the amount that must be used in non-attainment areas for projects that address particulate matter.

This section: 1) requires a 180-day deadline for certain decisions by federal “reviewing agencies” (such as Fish and Wildlife Service) regarding whether or not a project can go forward; and 2) sets the financial penalties for those agencies if the deadline is missed.     FHWA – Request for applications for a MAP-21 program under which approximately $14 million in "Accelerated Innovation Deployment" funds are available to state DOTs, and tribal governments (another $1 million is set aside for federal land management agencies). Eligible projects are "proven innovative practices or technologies" (by recipient or sub recipient) related to: planning, financing, operation, structures, materials, pavements, environment and construction. Awardees must develop performance targets for the project. Applications should be submitted within six months of the date the project is scheduled to begin. A final report to FHWA, documenting processes, benefits, and methods to support innovative practices shall be submitted within 6 months of project completion.

    FHWA – MAP-21 required FHWA to draft model contracts for certain types of P3 agreements. They gathered comments, and have now issued the first one – a “Core Toll Concession Model Contract Guide.” They emphasize that the model is intended to be informational rather than mandatory. (Based on input from the Jan. 9, 2013 FRN, the second most popular type of P3 is the availability payment-based contract, involving payments from the public sector to the private sector. They will publish a model for this type of contract sometime in 2014.)

A few of the major changes: 1) the standard transferability provisions of Sec. 126 (50%) now apply to most CMAQ funds (up from approximately 20% under previous rules); 2) FHWA will evaluate proposed projects based on a set of cost-benefit graphs and tables they are developing; 3) the limit on use for operating funds is revised to allow transit agencies to spread third-year funds over years four and five (In a July 2013 email, SPRC argued that this was too restrictive); 4) the use of operating assistance for passenger rail is specifically allowed, regardless of the area served; 5) diesel retrofits now get "priority consideration" for funding; 6) certain bicycle and pedestrian programs are eligible; 7) FMIS coding for certain mandatory and flexible spending is new; 8) the requirements for performance plans are discussed and will be the subject of rulemaking.

    FMCSA and PHMSA – final rule addressing safe clearance at highway-rail grade crossings. While the rule mostly stems from the Hazardous Materials Transportation Authorization Act of 1994, it also reflects a MAP-21 provisions clarifying that the provisions cover “commercial motor vehicles” rather than “motor carriers and motor private carriers” as the preamble for the original NPRM was worded. Drivers of CMVs or vehicles transporting certain hazardous materials, etc., are prohibited from entering onto a highway-rail grade crossing unless there is sufficient space to drive completely through without stopping.

    FTA and FHWA – Final rule primarily adding new categorical exclusions for transit projects. Although the proposed rule (March 15, 2012) was in response to two Executive Orders from 2011 (on streamlining regulations), FTA notes that the final rule is consistent with MAP-21 which was signed into law in the interim. One change was made specifically to conform with MAP-21: early ROW acquisition for FTA projects is no longer limited to railroad ROW. Part 771 of the Title 23 CFR is a joint FTA-FHWA regulation, but this final rule relates almost exclusively to FTA and FTA grantees.
