FMCSA – requests comments on FMCSA’s method of implementing a new MAP-21 requirement that states have a State Commercial Driver’s Licensing Program Plan. FMCSA intends to provide a spreadsheet or pdf document which states will fill out, including information about any deficiencies cited in recent audits, and details on how they intend to get into compliance.

FHWA – request for comments on FMCSA’s plan to ask all state law enforcement agencies about the degree to which they have adopted the Model Minimum Uniform Crash Criteria, in order to determine how consistent the various states are in their definitions and coding. The ultimate goal is to help FMCSA develop performance measures for the HSIP program as required by MAP-21.

- Nov. 12, 2014 FRN: Final guidance re: Corridor preservation for transit projects

FTA – notice of final guidance for preservation of corridors for future transit projects, in light of MAP-21 amendments to the code to allow certain acquisitions before completion of NEPA. The guidance addresses the type of ROW to which the MAP-21 provisions apply, and explains the related conditions and requirements. FTA had included a link to the final guidance application, however an incorrect version was accidently posted prior to 11-19-14, the correct version is here: http://www.fta.dot.gov/12347_15129.html.

- Nov. 7, 2014 FRN: Entry Level Driver Training Survey

FMCSA – the agency is planning to submit an Information Collection Request to gather information regarding the connection of CDL entry level driver training, as effected by subsequent employer training given, to safety performance of the drivers. Results from the study and other sources will provide information to FMCSA backing its knowledge of heightened MAP-21 minimum training requirements for CDL ELDT drivers from those that are currently required.

- October 24, 2014 FRN: Final circular for Sec. 5311

FTA – notice of final circular for Sec. 5311 Rural Area Formula Program, reflecting the MAP-21 changes. The Iowa DOT and several others asked for clarification on the topic of subrecipients for Sec. 5311 funds. FTA revised the circular to clearly indicate that non-profits are eligible subrecipients. Other issues reported in the notice include: FTA’s response to a commenter’s observation about the difficulty of replacing vehicles since Sec. 5309 was repealed, and; use of the terms “senior”, “welfare recipient” and “eligible low-income.” Also discussed is the eligibility of feeder bus service to rail and other networks. This circular is effective Nov. 24, 2014.

FHWA –Federal officials have reached an agreement with the Texas DOT to let them assume responsibility for NEPA reviews on transportation projects with FHWA oversight. Texas DOT applied for this through the Surface Transportation Projects Delivery Program; previously a pilot program. Section 1313 of MAP-21 made the program permanent and did away with the 5 state cap. A proposed memorandum of understanding is open for comments.

FHWA and FTA – final rule addressing joint procedures implementing NEPA by adding: 1) new CEs; 2) allowance for state DOTs to process certain CEs with less review by FHWA; and 3) adding an additional section on programmatic agreements between FHWA and State DOTs that allow State DOT’s to apply FHWA’s CEs on behalf of FHWA. Effective Nov. 5, 2014.
